Nursing Home Report

California’s Department of Health Services’ Licensing and Certification Division can issue citations and assess civil monetary penalties against facilities and nursing homes that violate the laws and regulations. Licensing staff has discretion to set the class of citation and the amount of the penalty according to criteria established under law, including the severity of the violation and the impact on the resident(s).

 

Since California’s citation system was first set forth in the Health & Safety Code in 1973, the law has been amended numerous times. The most recent amendments, effective January 1, 2001, increased the maximum fines for citations issued against skilled nursing facilities and intermediate care facilities.
